Biography
An expert competition economist with more than 15 years of experience, Nicola Tosini has advised the merging parties in numerous merger reviews by the European Commission and national competition authorities, including Cogne Acciai Speciali/Mannesmann Stainless Tubes, Danfoss/Eaton Hydraulics, BASF/Solvay’s Polyamide business, Quaker/Houghton, IAG/Aer Lingus, Atlas Copco/Geveke/LEWA, Boston Scientific/Lumenis’ Global Surgical business, Lanxess/Emerald Kalama Chemical, Fujifilm/Hitachi’s Diagnostic Imaging business, Showa Denko/SGL, and Continental AG/Veyance Technologies.In addition to merger reviews, Dr. Tosini supports firms and their legal advisers in antitrust investigations, the litigation of damages, and public policy issues. He acts as expert witness in numerous antitrust damages proceedings before national courts, including collective proceedings before the Competition Appeal Tribunal in the UK.
Dr. Tosini recently directed a multi-disciplinary consortium in the preparation of a study on behalf of the European Commission, looking at all 100-plus antitrust remedies and commitments decisions taken by the Commission between the entry into force of Regulation 1/2003 and the end of 2022. The study includes the ex-post evaluation of remedy implementation and effectiveness in 12 of these cases, based on interviews with the case team and market participants.
His experience spans a variety of industries including automotive parts, building materials, chemicals, consumer packaged goods, digital music services, electronics, fluid power systems, freight transport and forwarding, medical equipment, passenger air travel, pharmaceuticals, retail, steel, and telecommunications.
Drawing on his case experience and academic training, he has published in the Competition Law & Policy Debate, the Neue Zeitschrift für Kartellrecht, and the Journal of European Competition Law & Practice on issues that arise in the evaluation of horizontal and vertical mergers. One of his earlier articles on the significance of innovation in merger assessment, published in Antitrust Magazine, was awarded Concurrences’ 2019 Antitrust Writing Award in the Business Articles—Cross-Border Issues category.
At the Centre for a Digital Society of the European University Institute, he has participated in multiple panels discussing ex-post and ex-ante regulation of digital markets. An article he wrote on this topic appeared in the Italian financial newspaper Il Sole 24 Ore.
Dr. Tosini was a research assistant in the Department of Economics and the Wharton School, as well as at the Federal Reserve Bank of Philadelphia, during his MA and PhD programs at the University of Pennsylvania. He received a Marco Fanno scholarship for his graduation from Bocconi University in Milan. He is fluent in English, German, and Italian.
